For the regulation of weight and measurement items in India under the Legal Metrology Act 2009, a dealer license is a must. Without a dealer license under Legal Metrology in India, you cannot regulate pre-packaged goods. In India, the sale of weighing and measuring instruments is regulated under the Legal Metrology Act, 2009. According to Section 23 of the Act, every dealer dealing in weight and measurement items must obtain a dealer license from the respective State’s Legal Metrology Department before starting sales. Free sale of such instruments is not permitted, and each state government governs this process based on its jurisdiction. Importers who bring these items into India must also obtain a dealer license if they wish to sell them, even if they have already imported the goods legally.
The process of obtaining a dealer license involves applying to the State Controller of the Legal Metrology Department where the business is based. While some states offer an online application system, physical inspection by Legal Metrology Officers remains mandatory in all cases. Applicants must often provide a Dealership Agreement with the original manufacturer and may be required to submit a Non-Objection Certificate (NOC). Authorities also verify whether the business address provided is a commercial location, as commercial premises are generally preferred and acceptable for license issuance.
After obtaining the dealer license, it is mandatory to maintain complete records of all sales and purchases of weight and measurement items. Dealers must ensure that all instruments sold are model-approved, verified, and properly stamped by the Legal Metrology Department as per Section 24 of the Act. Failure to comply may result in penalties or license cancellation.
