It ensures that the production of weight and measurement instruments complies with government standards. Obtaining this license is mandatory for getting your products certified and legally approved for sale in the Indian market.

What Is the Importance of a Manufacturing License?

The Legal Metrology Act was introduced to enforce standardization in weights and measures for goods sold or distributed in India. This regulation is essential to maintain fairness and accuracy in trade and commerce involving weight and measurement.

To ensure such transactions and products are regulated without discrepancies, a Manufacturer's License is required. This license ensures manufacturers adhere to prescribed legal standards and build consumer trust.

Anyone engaged in manufacturing, dealing, repairing, or importing weight and measurement equipment or commodities must obtain a valid license. To maintain compliance and transparency in the Indian market, an LMPC Certificate is essential.

Manufacturing License Under Section 23 of Legal Metrology

Section 23 of the Legal Metrology Act prohibits any person from manufacturing, repairing, selling, offering, exposing for sale, or possessing any weight or measure without a proper license issued by the Controller of Legal Metrology.

The license is issued in a prescribed form and manner, with certain conditions, and is valid only for a specific jurisdiction after the payment of applicable government fees.

License Requirement for Manufacturer, Importer, Dealer, and Repairer

Any individual or company involved in the manufacture, import, repair, or sale of weight and measurement instruments must obtain a license. The application should be submitted to the Controller of Legal Metrology or an authorized officer using the appropriate form as outlined in Schedule II-A.

A manufacturer is not required to obtain a separate repair license for instruments they manufacture if the repairs take place in another state. However, they must inform the relevant Legal Metrology officer about such repairs.

Schedule I – Special Provision for Meghalaya

Manufacturers, dealers, and non-tribal traders operating in the VI Schedule areas of Meghalaya must obtain a trading license from their respective Autonomous District Councils.

Schedule II-B – License Renewal

Under Schedule II-B, a manufacturer, dealer, or repairer must submit a license renewal application to the Controller or designated officer at least 30 days before the license expires.

Under Schedule III, prescribed forms are provided for licensing any manufacturer, dealer, or repairer of weights and measures. The license is issued by the Controller or an authorized officer under the Legal Metrology Act.

Schedule IV – Licensing Fees and Alterations

The fees applicable for licenses related to manufacturing, repairing, or importing weights and measures are detailed in Schedule IV of the Act. If any modification is made to an existing license or a duplicate license is issued, 50% of the original fee will be charged.

License renewal must be done within three months from its expiry date. If permitted by the Controller, delayed applications will attract an additional fee as mentioned in Schedule IV.

Schedule V – Register of Licensed Entities

As mandated by Schedule V, the Controller or Director must maintain a register of all licensed manufacturers, dealers, and repairers. These licenses are non-transferable and cannot be sold or assigned to another party.

Schedule VI – Security Deposit and Compliance

Every licensed repairer must furnish a security deposit for each license to the respective State Government. Moreover, license holders must maintain the appropriate tools, registers, workshops, and equipment as per the conditions of the license.

License Validity & Renewal

A license granted to a manufacturer, dealer, or repairer is valid for at least one calendar year. Upon completion of the term, it may be renewed for up to five years based on regulatory compliance and approval.
